This currently only works on 4.0.0 - 5.1.0, and assumes you have a method of entering RCM mode, and sending payloads.
I will set a WARNING! here...
This DOES NOT works in 4.0.1 (and maybe lower)
I tested it myself and found that this works on 4.1.0 after updating from 4.1.0 using a cartridge.
ReiNX keeps in black screen after the logo in 4.0.1 and if you switch to the 3.x files (with no sig patches) it works fine.

This works in 4.01 I am 4.01 out of the box, followed the OP's original post with files exactly. Running on atmosphere with sig patches, not reinx. I still haven't updated.

Question 1: What is the advantage to using Devmenu as opposed to Tinfoil? I am having no issues installing backups and playing them with Tinfoil.

Q2: Isn’t Devmenu a serious ban risk or is this still just assumption?

Q3: Wait, so you can install to system NAND instead of just SD?

LOL if we keep our switch offline alway does't that mean that we are ban ourself from Nintendo service? :). For up post what every we do that modify switch or OS temple with either tinfoil or devmenu is result in ban anyway, the matter is when and what Nintendo got you for :)

When people say don't connect online does that just mean when your running the cfw/back ups or never again till a better solution comes out?

Sorry I never really see a clear answer on this and eager to try it but prefer to wait if it's a autoban.

I connect online and play, but not in CFW. I always turn my internet off when in any CFW mode, but when not in CFW I use my Switch like normal. I have fakesigned NSPs installed and use CFW for emulators and such. No ban yet, still playing Fortnite

Running anything unofficial on your system NAND leaves traces well after you are no longer running them. Some of these traces are known, but there are likely others that are not. With that in mind, there will always be a risk connecting to Nintendo (online) if you have a history of running unofficial software on your system NAND. In the future, offline EmuNAND (SD card) may alleviate this in the sense that you dirty the emulated NAND and only connect online with your clean, untainted system NAND.

Gotcha! I guess I'll wait it out for the time being. I'm enjoying splatoon to much right now.

To further clarify, there will never be a ban-free way to play online when you use unofficial software. It will always be a game of cat and mouse between Nintendo and the community. Methods will arise to subvert measures that Nintendo has in place to detect unofficial software, but you should never believe them infallible as you can bet Nintendo will begin planning a new way to overcome those measures as soon as they learn of them. An offline-only emuNAND seems like a "safer" approach, but who knows if such a thing will also leave traces on your system NAND in unexpected ways when it comes into existence.

Asking for a ban. Nintendo obtains a manifest of your games and their unique identifying data anytime you connect to the internet. They have a pretty good idea if you own a title or not (with some exceptions). I have little doubt that they keep databases of every switch that has connected online and what titles have been registered to them or linked to a Nintendo account.

Follow-up edit: Just running with that last thought... If such a database exists, which it has to, it would be unbelievably easy to check if a game with a unique certificate is popping up on thousands of consoles (i.e. everyone is installing/running from the same file). Other things I would look for to differentiate a mass-pirated game from a rental game would be to see timestamps of a game loading on a console. If there are >10 consoles loading the game within a day of each other, it is a dead giveaway that the title is being pirated.

Oh I dont plan on playing my backups online. I just meant that I wanna be able to run homebrew/backups when using CFW and when I wanna play online use the stock FW/different memory card without getting banned. I'm cool with waiting for an Offline emuNand to come out. Seems like its gonna be the safest way.

I am of the same mind as you. Content to wait for an emuNAND solution, for now. My patience will likely run out if nothing materializes before November though; then I will have to sacrifice the sanctity of my sysNAND.

I didn’t wait, and so far I have no issues playing backups offline CFW and then playing my legit titles online in OFW

Make sure the name of the .NSP has 64 characters or less and contains only alphanumeric characters. Also make sure wherever you are installing has enough room that is double the size of the .NSP (internal memory or micro SD).

Strictly [A-Z][a-z][0-9]? Not even underscores? (e.g. GameName.nsp is good, but game_name.nsp won't work?)

I loaded a lot of games already and don´t want to redownload them as NSP
