I have written the letter stating the Consumer Protection (Distance Selling) Regulations 2000. I have copied the letter to Zappies and will send both by recorded signed for post today. I have also mentioned court action if they do not issue a refund in the next 7 days.
With regard to watchdog I have filled in their complaint form in the link below. The sub category I chose was hardware and said that it is a NDS media player. If we all fill out the form on-line then we might just get a response from them.

Edit: The letter sent to Zappies is being returned to sender so the registered address obviously isn't correct. Still waiting to see about the one sent to nowplay
