It could be a contact issue where the cart shifts after booting. Just throwing out ideas. Best I can suggest is check the bootstrap version (not sure how to besides running the updater again) and check that is really was updated.

HW:81 was fine with the bugged update. Only HW:44 had issues with it.

I think you should only use the version that corresponds with your hardware.
Eg;
ak2ifw_update_3ds_v1_DSi = DSi, DSi XL
ak2ifw_update_3ds_v1_DSL - DS Phat, DSL

The DSL version ONLY works on the DS/DSlite, but the DSi works on DS/DSlite/DSi/DSiXL
The only difference between the two versions is, DSl version asks you to swap your card first. This allows for 'unbricking' and multiple updates. The DSi cannot swap cards without returning to the menu, so it must flash the device it was run from.
