Homebrew About "StreetPass" and "SpotPass"

I see StreetPass Mii Plaza, Tomodachi Life & Kirby Triple Deluxe needs StreetPass to be turned on in order to have full gaming experience, but is it safe to do so if my N3DSXL is B9-ed? (Didn't cheat except in Pokemon Moon though)

Someone said doing this can prevent the Wifi bans:

Go to System Settings, then “Internet Settings”, then “SpotPass”, then “Sending of System Information”
Disable the “Sending of System Information” option
Exit the System Settings
Go to your Friend List (the Face Icon in the top row of your Home Menu)
If you receive an error and are kicked out of the menu, the Friend’s List setting is already disabled
Go to the Friend List settings, then “Friend Notification Settings”, then “Show friends what you’re playing”
Disable the “Show friends what you’re playing” option
Exit your Friend List

But is it enough? thx

You can get banned from running invalid title ID's. That's it. No matter if the game was acquired legitimately or illegitimately. I have into detail about this here, even if about of it doesn't apply to you. I just found I worded it nicely here:
I haven't read everything here, but to debunk most of this, if the op is really this afraid, deleting all Homebrew apps would make the console indistinguishable from a vanilla 3ds. A cfw in essence is just several patches applied to the 3ds OS upon booting. Everything about your nnid being tainted has no evidence whatever, and is complete paranoia. The only possible way it could be detected if you have a cfw with nothing else installed is if you sent the console into Nintendo to get it fixed. My advice is to update a9lh to b9s. This will allow you to use any Homebrew app you like injected into DS download play. This completely conceals what you're doing, while opening access to everything you've been doing prior untill now (emulators, hb games etc. )https://3ds.guide/a9lh-to-b9s.html

Not how it works. Title IDs are codes that your console recognizes to allow the application attached to run. CFW makes the console 'forget' to check but SpotPass and StreetPass don't.

I think that as long as you don't active Streetpass/Spotpass on an out-of-region game (eg.: I have an EUR 3DS and I leave Spotpass and Streetpass active on Monster Hunter XX, a Japanese game) or homebrew (which I think they don't have that option) you should be ok.
Also keep in mind that some software such as Streetpass Mii Plaza show what game you last played, so if you played an out-of-region game or a homebrew title you could leave some hints that you have a CFW 3DS

I think I'll probably turn StreetPass ON but SpotPass OFF for all games, as the first one seems to be interaction between players, while the second one might send/receive info to Nintendog
