Hacking 3DS Security idea

I had an idea. Maby Nintendo will start making special 3DS games that only work with a firmware update! This firmware update, also disables flashcarts! Those pirates will be screwed. I wish it would happen but if it did, then they would just make new flashcarts anyway. But it's a cool idea anyway, so tell me what you think in the comments.

Unless you mean auto-updating games, it's how it is already.
If you do mean auto-updating games, then that doesn't change a thing.
It wouldn't make the game special to do either.

I want to clarify this in light of the recent thread:
By auto-updating I mean
*boot, check internet for latest firmware version, check system firmware version. if 1>2 - update # else - play.
I don't mean it would update your 3DS without you clicking "accept" at some point, and being given a choice to update.
 
Don't they already try to do that with the wii? Problem is, once a console is hacked, you can pretty much do anything, including bypassing all checks and blocks.

A 3DS system menu need to be online. What if they release a faulty/glitchy system menu and put them on the latest game? Caos, hacks and stuff. And they, Nintendo, can silently cover holes in their system. Guess they´ve learned the lesson with sudokuhax. The best bet they can do is to ship irresistible content inside a firmware update (through internet), so they can be sure you´ll update anyways, or either replace any buggy app with a patched/improved version of it.
