I'm interest in buying 2nd hand of NS. But, I want to legimate play this console (For online purpose).
Is there any point or way to check that the console is clean, never hacked before?

No. You can check if it's been banned already, but not if nintendo are preparing to ban it.

Unfortunately no. Might be a good idea to buy locally instead of online, so if you're banned you might have some kind of leverage for a claim.

Someone can backup their nand before using it for the first time, hack it, take it online and restore it completely.

How do you think it would be possible to check for that?

There is no safe way of knowing it. You could check error codes in system settings to see if there is something fishy there and I would also check the joycon rails to see if they are bent/scratched.

Not showing these sign doesn't mean that the switch is unhacked but positive results would mean a hacked switch.
