This is only a temporary solution. Eventually, new games and new game updates will not be able to be patched for 11.0.0 as future software development kits start to be used.
If you are ripping your own game carts it's also not a solution. For example, I have the game cart for "Immortals Fenyx Rising" and if I insert it into one of my unmodded Switches on 11.0.0 it works fine, but if I insert it into an SXOS switch on 10.0.1 I cannot even rip the game to begin with. Kind of hard to patch a game that I can't rip in the first place.
So sorry a piracy company offering an illegal product isn't being customer focused
The legality of copyright infringement varies by location. In America, where I am located, it's a civil matter rather than a criminal matter. Of course, it can become a criminal matter in some circumstances. Still, it is my opinion that there is a difference between piracy and enabling piracy. Individuals should be responsible for their own individual actions, and the fact remains that there are legitimate uses of their product.
Contrary to popular belief, there are reasons to use game backups other than piracy. I always, immediately, backup all of my games. I buy physical, but I back them up and unless I plan to play a game online I keep the cart in a safe place. I even purchase limited run games on a regular basis and keep them well protected. I also purchase multiple copies of games of I intend to use multiple copies at once. I also buy the same game again on later consoles. For example, I own Grandia II for Dreamcast and Grandia HD for Switch as a physical cartrige. I own all the Pikmin games for Gamecube, Wii, Wii U, and Switch. I own Myst for PC and Switch. In other words, I'm not pirating. Nintendo would of course disagree, but they are entitled to their opinion.
One reason I prefer playing single player games on SXOS is the ease of backing up and restoring saves. If my online Switch died, guess what? All my saves will be gone! Sure, there's cloud saves - and I pay for Nintendo Online family plan - but really, most games I play don't support it.
I could also do that on Atmosphere, but in Atmosphere you have to install games and If I installed more copies of a game than I owned that would be piracy. It would be a real pain to have to uninstall and install games constantly. Especially when compared to the ease of just dragging the game onto and off of an sd card. So for someone like me, who owns multiple Switches, but only multiple copies of some games, Atmosphere would be the piracy OS. Not SXOS.
