Quick question: are there any confirmed console bans after transferring an account from a banned switch to a new one? I'm planning on getting a second switch for online play at some point.
Console bans after transferring an account from a banned Switch to a new one? Yes. Confirmed? Well it wasn't posted here nor did they fill out a ban report form so I'm teetering on no. Not to mention said user has been suspended from GBATemp in the past so take that for what you will. Lastly, I've had other people confirm so far that their consoles have been fine despite linking an account from a banned console.
Hey Drax, in June-ish, I used like the Hekate Mod 3.2 or something. I booted into RetroArch and some other homebrew apps. I’ve crashed a couple of times using them. I have since turned off my switch (the FW is still 4.2) am I screwed if I boot into my original FW? Should I wait until Atmphosphere’s thermosphere/EmuNand fully releases?
If you don't have a clean hack-free NAND backup, you may be out of luck. However if you're willing to experiment, another user wrote up a way on how to manually "clean" out your NAND which you can find here under "Clean Up SysNAND"

I don't think you can transfer from a banned switch. Superban only?

Lets say you have an online family plan for multiple switches. If one of those switches get banned, what happens to the others, are they unable to use the service now or no?

I'm actually wondering a similar scenario. I've used my 3DS with cfw for a couple years with my Nintendo ID. Not banned but now I'm worried because some updates came through. I have switches under my ID. Would they blanketly ban everything? Or maybe I should say has there been anyone that's happend to?

In that case, you wouldn't transfer the account but set the other Switch as a secondary console under the Account.

This is the same scenario as getting your console banned then using the account that was linked to that console on another console. Hypothetically there is a risk of getting the second console banned but realistically, as long as the console was never hacked, a ban should not occur.

A Nintendo Network ID is different than a Nintendo Account although you can link them together if you want to.

I have a Friend with a hacked console and he has accounts on it with digital games that he would like to give to us, but he is worried that if we use his accounts on other consoles maybe Nintendo could ban us too, is that possible? Should we use his accounts on our legit consoles? Would Nintendo ban us?

Possible, yes, but realistically not very likely unless all of you have hacked your consoles.

So I'm still not banned! Today I initialized (cleaned nand?) & updated my console to 6.2 from Nintendo's Official Recovery mode. I re-linked my Online ID. Now I exclusively use SXOS emunand for homebrew/backups. I'm pretty confident that I will never get banned now!

With "cleaned nand" do you mean restored previous nand backup with hekate? How much space did emunand eat up from your SD? I'm getting a lot of different numbers here...

It's not a true clean nand. I used the Initialize option in Nintendo's official Recovery mode (power+VolumeUp+VolumeDown). It will probably will help though. The SD has 89.9GB Freespace after installing emunand on my 128GB SD.

If I update using chidori from 6.0.1 to 6.2 and go online how high is the risk of me getting banned because from my understanding there is no way of getting my system back to a clean hack free 6.2

With ChoiDujourNX, you have a slight risk since that involves booting CFW/homebrew. With ChoiDujour, your risk is greatly diminished since it relies on RCM which is virtually undetectable since it is loaded before the NAND.

I think that someone could make Checkpoint to backup or restore the saves in RCM without go to CFW, so is it possible?
