I have a new Nintendo 3ds XL for 6 months with CFW. Use it on common sense. Always have a risk to get banned. If you want to play online safely, use original FW.
Wow okay I’m not paranoid about getting banned, just want to avoid making any obvious mistakes that would get me banned sooner than I would have been otherwise!

We don’t know what can cause a ban, we know that Cheating on games and using online features with hacked games will put you on risk, playing games before being release too is a risk, using homebrew CIAs online too is a risk. But let me tell you what i do:
I purchased a game a and I use it to load the HL, and use the .3dsx Freeshop version it looks like I’m playing a game I purchased.
And basically I use every Homebrew on that game.

We don't really know the extent how the ban works. You can try protect yourself. But yet I guess we'll see another banwave with the release of ultra Pokemon. Then we might get even closer to why it happens to some and some are just fine. But it's just a guess and some options are probably safer but once on cfw, one should not expect less than a ban if it would occur.

Playing CIAs online is not safe unless they are legit or purchased.
Even starting them with an active internet connection may not be safe.
What is probably safe
1) sky3ds+ with unshared headers online.
2) legit CIAs online.
3) playing any software without an active internet connection
4) running homebrew version of freeshop with access patch (rosalina trickery is oen way)
5) playing legitimately purchased CIAs online.
What i think is dangerous.
1) running any unsigned CIA.
2) playing pirate stuff online. only .3ds with unshared private header is safe for online.
3) cheating online. (this really pisses them off)

and what if nintendo matches the header to a game that is not the one you are playing.
there are so many if's that no one knows for sure
