We don't/won't have the keys from 3.0.1 and future updates, so while you can run unsigned updates, they won't match to Nintendo's because you won't have a key-match. From here on, 3.0.1+, and 3.0.0 and lower, will grow apart.

I updated the other day, as was wanting my Splatoon fix. To be honest, I'm not butt hurt. When it comes to piracy (which I'm not against by any means). I'm now in a financial position to buy games.
As far as homebrew/emulation is concerned, I have other devices that fit the bill quite nicely.
