What is the proper way to tell if you are banned?
You can either check your friends list or a game online. Although some games like Animal Cross my still allow you to go online. MK7 is my game of choice because it gives the banned error code only nano seconds after trying to go online

I believe people are over-reacting about getting banned. If you think back, any amount of years, when players had playstation 3's with custom firmware everything was all great, fine and dandy similar to this.

Then sony issued both console, and psn account bans for anyone who even used a hint of homebrew. When this occurred I don't believe there was a large rant of people complaining like this. I am sure their has been bans regarding other systems as well i.e. xbox, wii, etc.

I believe you just need to suck it up; I did with my ps3, sure its banned from all online forever but it is still cfw, meaning backups galore.

Fixing your system (3ds) is most likely going to involve breaking another system; via stealing their online ID a specific code, and putting it on your system and you'll have to pay quite a bit and trust them. In the ps3 case you needed a genuine clean console ID, and a PSID from another not modded system.

In essense your breaking one system to fix the other; so it will cost you money.

Deal with the 3ds ban, suck it up, or by another for like $100 i'd say. Just my 2 cents

you need a genuine new 3ds with this too, since bans will keep on coming back. alternatively, people work together to get new friendcode seeds.

Okay, the system I tried it one says is restricted by nintendo. But i have 3 more i haven't used actively. I guess the problem was i usually have it sleep mode with wireless on all the time, the others are always off.

The new 2ds is cheap enough at $80, and I doubt the seed codes are tied down to a specific console type. Or you could chance buying a cheap used 3ds off of Craigslist.

I'm doing both, both checking my friends list and MK7 and still haven't got banned.
Either they were targeting some people specifically or I don't know.

By either using a seed that somebody has posted online for anyone to see (we call this a public seed) or by using the seed from an unbanned 3DS (like from a friend or an old one they may have had lying around).

I better do some reading. I'm clueless. It seems that if I public seed it will get banned quickly and if I use an unbanned seed I own...that it would get banned just as quick...but again I haven't ready up on any of this. My son just alerted me his 3ds xl is banned.

Well, a basic primer:

Public seeds are just that, public. If a large number of people are sharing the same public seed (which is very likely), Nintendo can see that pretty easily and ban it. Also, if anybody using that seed does anything that would cause them to get banned, everyone using it will be banned as well. But then you can just search for another one, since generally public ones are free. If you use an unbanned seed that you own, there are certain steps you can take before using that seed to help prevent getting banned again. For one, you can disable both options under Spotpass in system settings. Also go into your friend list options and disable the option to share the game you are currently playing with friends. Go into Mii Plaza and make sure your "favorite game" is set to a legit game and not something homebrew-related like hblauncher_loader or FBI. This will help avoid sending title ids to Nintendo. If you use soundhax to load the homebrew launcher, the only title id Nintendo can see is the sound app, so you're safe if you do that. If you then load FBI with it, you can uninstall any homebrew-related CIAs you may have installed (FBI, hblauncher_loader, luma updater, BootNTR, FreeShop, etc.). Then, only load homebrew through soundhax. That should be relatively safe. Use Cthulu to wipe your activity logs, that's one less thing Nintendo can check to ban you.

Some people say that if you're playing pirated games, Nintendo can cross-reference that with a list of game purchases and can ban use based off of that. While this would be a relatively easy thing for Nintendo to do, we don't have any concrete evidence that Nintendo is doing this. There are also concerns that Nintendo can see if you're playing a CIA that was ripped from a game cartridge.

In this case you just have to decide what's more important to you, the ability to play pirated games or the ability to play online. The survey data is mixed, there are plenty of people who are banned and at least claim that they weren't using any pirated CIAs. There are also people claiming that they are playing pirated games online fine without being banned. But there are also lots of people who play pirated games and did get banned, so we can't tell anything for sure.

I even heard that the banwave stopped, but we don't know if Nintendo is still tracking data, keeping a list of consoles to ban in the future.

My advice, if you want to play online go ahead and follow the steps I outlined above. Then try unbanning it. The worst case scenario is that they ban it again, but either way if you don't unban it you're still not playing online.

I believe that if you're really that tired of seeing people react to their consoles getting banned, you should suck it up or stop visiting a forum revolving, primarily, around homebrew and Nintendo consoles.

Just my two cents.

They can only cross-reference the games you own if you have a NNID. The data for redownloading games is actually on the console itself; but when you use a NNID, it gets stored on Ninty's servers.

Even without an NNID the info is still on the servers. For example, I bought a console with the Ambassador games and no NNID a while ago. I modded it, took a NAND backup, and system transferred to another console. On restoring the backup the games came back, but after going into the eShop and back out, they all disappeared. The servers knew that this console no longer owned those games.

He posted this on the 3dshacks reddit too.. probably trying to rile people up.

Really I haven't seen much whining in this community about the bans.

Oh wow! When I last read up on the eShop and tickets, I was under the impression that information was stored only on the 3DS... This is news to me XD

Where is the n2DS $80? I thought it went for $150.
I apologize, I am mistaken. The O2DS went down to $80 before the N2DS was announced.

Either way, $80 will get you a new, guaranteed working, private unused seed. Or you can buy something cheaper used and still have a relatively good chance of getting an unbanned seed.

And between the recent banwaves and the Pokemon SuMo banwaves, I think being able to test whether a used 3DS-family console is banned before buying is perfectly reasonable.
