what annoys me is they don't stop you from accessing the eshop to buy more games, they don't stop piracy with this in anyway.

all it does is piss of people with cfw that have BOUGHT games from playing online. no more trading pokemon for me :/
I still play from the carts. I only use cfw for convenience, like region free, and occasionally undubs.

edit: can anyone that is banned confirm if they can still go to the e-shop and access games they have "bought"?

as far as i can tell yes ... i just cant access online play functions or friendlist type stuff anymore but i do appear to have full access to Eshop still

Yeah that's my issue with the whole thing aswell but right now there's nothing we can do :/

I am unbanned, have the option to send informations disabled, immediately after I bought the system.
Also my System is without a NNID.

there is at least 2 free dlc in fire emblem echoes, I downloaded both after being banned, don't know if there is a way to download the paid ones (without paying of course, lol)

Good to know. If you can access the in-game store for free or paid it shouldn't be any different.

Should that count when it's never been opened? My banned console never touched it, my unbanned consoles never touched it.

I wouldn't know, I used it when I first bought my console and never again, so I forgot about it, now I checked and it was on... maybe you could check in your banned console if it's on, since you never touched it

Well since I never touched it, wouldn't it mean that it's not activated? I booted it up, and apparently it's automatically set to "Off," and in order to turn it on, StreetPass has to be activated. Since this was a first time boot, I was presented first thing with the option of enabling StreetPass, and I turned that down. So since this was a banned console going through this, I can safely wipe out this app as a cause for the ban.

So... I have 3 3DS and 2 of them are banned. Luckily my main N3DS XL (64gb) isn't banned. Lots of hours, save editing, kinda cheated online but stop, and tons of games and homebrew apps. I was lucky to have the wifi off but i had to turn off the router completely off as it will get banned as the other too. My other N3DS(16gb) is banned thanks to Spotpass. So did my O3DS(8gb) though i turned off the wifi function as soon as I turned it on and its still banned. So yeah.. i don't really care much to play online but when the time comes, I will probably want to go online.

I have one 3DS, and it is not banned, I have Boot9strap on it, I have never cheated, I've had spotpass off since December, and I have no custom CIAs installed.

I'm surprised Nintendo has only now done this. NASC can see if you're using cart or digital and they have more than enough IDs to check on eShop. It was only a matter of time.

I have an old 3DSXL and a New3DSXL. Both options were on on both 3DS'. I am not banned on either of them yet. I also haven't turned on either 3DS in the last week or so.

Ok, I loaded my NAND backup, and now I'm back on stock, and I totally freaked out when I saw an error message appear when I opened friend list.
It was just a prompt telling me to update to use it, and when I did, it let me use it haha.
