Hacking Legal issues regarding installing Picoflys

I have been interested in installing picoflys for peoples switches as a service provided. Curious if there would be legal issues regarding this as long as i dont include any software or anything like that on it. Any advice would be appreciated

I wouldn't try it if I were US based.

It's a Raspberry Pi Pico, importing one from AliExpress won't result in it being seized.

Possibly could, Nintendo recently sued someone selling Mig Switch and Modchipped Switch.
I didn't see they sued someone selling modchipped switches, the migs i understand since it violates dumping cartridges but if i only sold a service of instaling the modchip itself but not providing any software and strictly discouraging pirating of any kind

They went after people installing SX chips in the past. So why wouldn't they go after Pico installs also?
SX OS uses copyrighted Nintendo code, which makes it an easy target.
If they haven't gone after Picofly yet, I don't think they will. They seem more concerned about emulators lately and the Switch is at the end of its life span. There aren't any huge releases left (biggest is probably Metroid, which is reasonably popular but doesn't see anywhere near the numbers of Zelda, Mario or Pokemon), but right now their focus is probably on developing games for the Switch 2 to have them ready for release.

The same argument about dumping cartridges could be made for Atmosphere, it has the ability to dump xcis and nsps and all you need is a piece of homebrew, which Nintendo could argue constitutes circumvention of copy protection.
It's not worth Nintendo's effort to go after a small time modchip installer though, there are just too many of them that it would have zero impact, and they can't go after them all, the most that's likely to happen is a cease and desist (which you should probably listen to if you get one) which doesn't cost you anything so you don't have much to lose.

Except the SX chips came blank as well, however advertised for one thing only. Picofly is impossible to kill, but anyone announce it as a business can get the wrath since it's just for Nintendo to ask someone for an order and bam got their address. That's what they did in the past.

Thank you for your through response i really appreciate it, I figured the same since id be doing it small time with no actually piracy or hacking involved, im just soldering a modchip on it but not actually installing or pirating anything. I think they'd send me a letter to stop doing it before anything else since it couldn't be worth their time. They need to spend time on development and not lawsuits all the time
