Greetings bruv, I'd like to note that I've done multiple things in the "Instant Ban" category and haven't got the ol' hammer for a couple of months now.

actually modding games ( no cheating ) doesnt ban, myself included i used retexture mods on mario kart 8 and didnt got banned.
and btw piracy and nsp isnt instant ban, we have video material on youtube from moddedwarfare where he is updating a nsp. what shouldnt be possible if he would be banned. but a few minutes or a hour later everyone is banned who did this

I have said this time and time again and I have tested this out & proved this theory myself for well over 14 months now without a ban. You will not get banned for backing up your own online purchased retail games in xci format with the correct certificate injected and using it in cfw with sxos online, if you sell or let the game go then you will eventually get a ban. I’m from the uk luckily so turn of your telemetry setting on your account, it might help none of us really know but do it anyway, if you’re outside the eu then your shit out of luck unfortunately! You might say what’s the point, why risk it when you own the game? the point of doing this is so you don’t have to carry all your games around with you so you have all your library on 1 micro sd card as well using your online titles at the same time and in my mind logically what harm am I doing to the Nintendo Company themselves? What am I doing that’s so wrong? Nothing at all! all I am doing is making my gaming experience easier for myself, nothing more!

Edit: no before you ask this won’t work for rented titles you will have just as much chance of a ban than sharing the certificate with many user!

Your guide is absolute rubbish following a discord channel “that most probably leeched there information from our research” and picking up hints on the way then posting a thread like this as if too say you know everything about banning related issues is just well.. crap! There have been members such as myself and others also @Draxzelex has a full banning thread with lots more information available to the user who have tested these theory’s out, stripped them right back and tested thoroughly right from the beginning of xci dumping so take your thread and your researched theory’s else where please. Best thing to do mods is please delete this thread asap all it does is confuse users on what’s already a mind field.

Source: Am also an unbanned user that strictly uses homebrew (RetroArch, source ports, other emulators, and that's it) for more than a year now.
As much as you can't ignore those who supposedly have received bans for X reason, you also can't ignore those who haven't received bans for X reason, especially for this long.

I too have used homebrew such as RetroArch and Checkpoint on my sysNAND. But I know there are others who claim to be banned for such things. Sure, they could be lying, and saying they didn't pirate games when actually they did. But we have no way of knowing for sure.

So I would still call it risky at best. Now I restrict all my homebrew usage to emuMMC, but if I get banned in the future I'll have a pretty good idea why.

My systems been sxos installed since launch. Nsp’s are installed. My systems still not banned. When I want to update games or play carts I own online, I reboot switch in normal mode and I play my carts like Mario maker 2 online or goto eshop with no issues. Still yet to be banned.
I just make sure when I’m in original mode, I don’t start up the installed nsp’s. And that’s worked so far so installed nsp’s don’t guarantee a ban if your smart

Guess this is place to ask. I done a nand backup ages ago but I had installed a game or two then done the backup. I wanted to start fresh as possible to have a clean nand backup for emunand. Dont lecture/criticize please just simple answers would be good

There is a good chance you are going to be banned without a clean NAND backup. You can try some of the alleged methods to clean your NAND, but know that they are unlikely to work.

Yeah anything I try I'll tell myself I'm gonna get banned it's no big deal but would be a nice extra if I can. Could the alleged methods be added to this thread? Feel like it ties in with the subject

Has your Switch been online before? Are the installed games legit?

If you're trying to avoid a ban, the games that were installed were illegitimate, and your Switch has been online while these games were installed, there's nothing that can guarantee you won't be banned in the future. That being said, you're probably best off simply deleting the illegit games, and see what happens. Building a "nand from scratch" is probably more likely to cause you to get banned than just deleting the illegit games.

If you only want to delete them so you'll have a "clean" basis for emuNAND, you're best off just creating emuNAND with what you have and then deleting the games once you're in emuNAND.

So you have pirated nsp installed and you're still fine when you play online with legit games?
