What about tell your brother to buy Switch on his own?

Some people got banned after they restored the clean NAND, so I guess that they went online with CFW. If you never go online like you said so restore the clean NAND should be safe.
As far as I know, no one has been banned for restoring a clean NAND as long as they didn't do any homebrew/CFW online.

The problem is there is no rhyme nor reason to the bans. There are people banned for the bare minimum while there are fully-fledged pirates who are still running free. Point is I can't advise anyone that they won't be banned for hacking their Switch unless they backup and restore a clean hack-free NAND prior to going online as well as staying offline with CFW/homebrew.


Yeah, and you're right to point that out, but I think the best approach would be advise the risks and telling people that the bans comes more if you pirate Switch games and not so much for homebrew (specially that the only person who reported being banned for using ONLY homebrew had about 5 or so posts on gbatemp and never posted again).


I myself stopped using homebrew after restoring my clean nand and nothing happened after that (thank god, because I wouldn't be able to afford a new Switch right now). But I've used emulators for about 6 months with wifi turned on while on CFW and nothing happened, so maybe we can learn something about nintendo's ban behavior with this.

Am I right in assuming that if I want to go online I would need to restore the NAND and allow the Switch to update itself to 6.2, meaning if I want to use CFW again I will need to use Atmosphere?

Any trusted DNS out there that blocks all Nintendo's servers ?

Yep, restoring a clean NAND is the safest way to avoid ban going online... You could also try EmuNAND to have 2 different firmwares , but it is, saddly, an SX OS specific feature for now. Up to you.

Make sure you never accidentally boot without Auto RCM i have done that so my clean n,ot online console is screwed now i'm unable to backup as i have burnt more fuses then the OFW is on

We're at nearly 20 homebrew only bans and people are getting banned for using LayeredFS without dealing with piracy. If we're talking about what action is definitely the unsafest, it is definitely using hacks online; piracy is not as high risk everyone makes it out to be which is just confirmation bias.

Are there reports of anybody being banned here due to SD card contents?

I had my fun with Smash this past week and decided to restore back to my original NAND backup today, never once going online on my custom firmware. Although while booting the new restored NAND, I left my SD card in with all the Atmosphere files on it (although I deleted Smash and the game save on the SD card before doing the NAND restore). My WiFi did reconnect while in the restored NAND as well.

Based on past experiences I think I'm fine, but am curious to know if anybody had a similar experience and ended up getting banned.

SD card contents don't indicate a hacked console since the SD card does not play any mandatory role in hacking. If you wanna go the extra mile, just picture a scenario where you insert your SD card full of .NSP and .XCI files into an unhacked Switch. Does that Switch violate the Terms of Service? If its not hacked, then the answer is no. An SD card is just an SD card; its only meant to act as a storage device.

You're almost definitely right (or so I hope), but if Nintendo were really inclined to catch people playing Smash early (or running homebrew), the OS could technically detect this and write a file to the SD card containing some UUID associated with your console or account, and then send that back to Nintendo servers from the SD card upon reconnecting.

I'm probably overthinking it though to be honest :blink:

Actually someone suggested comparing the space left on an SD card before and after CFW to see if anything was written to it but no one stepped up as tribute.

Assuming a file of some sort is written, it would likely be less than 1KB and probably pretty hard to detect just by checking the SD card's remaining space.

Regardless, I'll make a post here if I do end up getting banned.

I'd guess it's illegal for companies (ie Nintendo) to scan peoples SD cards and judge/read the content on their not specific to what we give them permission to see and use.

Data protection/GDPR etc...

I dont worry about whats on my SD card mainly for this thought

Additional Comments

Set up a separate microSD card for homebrew, with Atmosphere 0.8.1 and Tinfoil installed. Did a full backup of NAND prior to any modding or entering of a custom firmware. Downloaded, installed and then played a backup copy of Super Smash Brothers: Ultimate prior to street release date for a week or so (Amazon copy on order since March, I'm just impatient), console was never fully powered off after having installed the game and was always either powered on or in sleep mode. Yesterday, prior to reflashing NAND backup back to its original state, fully removed the game software and game saves through the Nintendo Switch OS. Console never went online whilst in the Atmosphere CFW, airplane mode set on OFW before booting into CFW, followed by the removal of all saved wireless connections. Console will never have a custom firmware on it again as I don't want to get banned.

Also to note, I accidentally left the microSD card with custom firmware and related files on it while booting into the backed up OFW after flashing NAND.

hi! i'm here to ask if i'm safe to use a legit game cart (splatoon2) used online with a banned console.. i don't know why i'm banned. i have sx os with airplane mode and i never play online just update games in the past. the last thing i do it's restore the console with clean backup (but with lover fw version 5.0.2 instead of 5.1 ) i have used online before with 5.1 than i restore clean backup fw 5.0.2 and update to 6.1 online. thanks for answear

because now i have a new console only for online and i don't want to be banned. i do the restore before been banned..

A legit cart is fine, a ban isn't contagious unless you bought a 2nd handed game that got its cert dumped. Play online as much as you want with it

A legit cart is fine, a ban isn't contagious unless you bought a 2nd handed game that got its cert dumped. Play online as much as you want with it
it's a my game cart new.. i dumped it and used with sx os never online and i don't remove te cert inside of it... it's safe? Thanks
