Isnt it actually called "fake emunand" (not real like on 3DS), the emunand method which SX uses? Does Atmosphere supports actually the "real emunand"? As far as I know, the fake emunand shares some data with ofw which should mean that its not actually safe enough and that it could lead to ban..... or did I miss something?
It's the same as any emuNAND the only difference is where it's stored.
Atmosphere doesn't support emuNAND yet.
No, they don't share data if you unlink the NANDs.

Using atmo here. Going online constantly. Still no ban either. So what?
And all ninty needs is to look for .bin on NAND. Tbh, I have no idea why they haven't implemented it already.
As long as you dont go online with an nsp or xci you should be fine.
Even updating nsps and xcis on OFW is fine.

And all ninty needs is to look for .bin on NAND. Tbh, I have no idea why they haven't implemented it already.
They always do the bare minimum to appease investors and publishers.
It might be in the next update. Then again detecting emuNAND on SD is just as easy so if they wanted to go that route then there would be no hiding emuNAND from them.

You accept a ban by modifying your console
knowing this, there's no way to prevent a ban, and stay offline isn't an option, since... c'mon, why would you want to not get banned when you don't use online

How to not get banned on a hacked switch
1. Buy private island
2. Stay there and never go on WiFi
No really, don’t connect at anytime when using a hacked switch

Then again, they can legaly look only to the Nintendo folder on your SD.
They can look if you have booted from SD (somehow, for sure).

If I am wrong on this, please show me the proof (nobody ever did that), cause I'd like to know why in that case Ninty can legaly access all my private data on the SD.
Also, if that's the case, they could have implemented looking for .nros.

SXOS emunand will NOT prevent a ban, this has been discussed over and over again, just because no one has reported a ban does not mean it will not happen. I had my switched hacked for almost 4 months before being banned and I kept an active wifi connection the entire time. The point is there is no rhyme or reason as to when Nintendo decides to ban someone.

I thought the only way to prevent a ban in the case of hacking your Switch is to make a virgin NAND backup before dirtying it up? Then when you want or need to go online again you restore the virgin NAND backup and all traces or errors are gone.

Is this not accurate information?

100% accurate. But with EmuNAND, you can go online on OFW and be safe (for now)

They don't need to look at your files, it would be a simple check for an emuNAND header or a CFW file that would be done on the Switch side, all Nintendo would see is the console asking the servers to flag it for a ban, which doesn't include any private information hence it's legal.
Niantic has been doing something similar with Pokemon Go by looking for a specific folder on the internal storage that only Magisk users would have, and blocking you from accessing the game if it's found. You can remove it and be able to play. If they wanted to they could start banning, but banning legitimate users simply for having a rooted phone would be a dick move.

In theory it shouldn't be possible (at the moment) for them to detect emuNAND or otherwise detect homebrew/CFW use that's being done on a separate NAND. That is unless TX screwed up (again)

    @The Real Jdbye, I thought about that and I have blank DVD's and Blurays but honestly after like 90 songs I just listen to it a couple of hundred times toss it out and burn something else or have like 2-3 CD's. Florida here the heat in the car tends to ruin the CD's after like a few months even commercial pressed ones don't last too long.
