The WarioWare Gold demo is multi-region for JPN, EUR, and USA. However, the decrypted title key uploaded at that title site is meant for the EUR version. Check if Nintendo eShop of Japan has that demo and get it from there instead. Do not download and play the one from freeShop in case your country doesn't have its demo officially released yet.

This currently goes for USA 3DS region users.

It should still work though. Maybe it needs Luma locale emulation enabled.

The working part is not the concern. It's the play before official release that may flag you with a ban that's the problem. I mean, you can get away it if you stay offline, but I like to advise those not to try it out to be on the safe side (for USA region at least, not sure if JPN has that demo out yet. EUR is known to have theirs).

Edit - I forgot to mention. If you check out this demo before your region eShop has it out, stay offline, delete title and ticket with FBI when you're done, and cache clear everything with Cthulhu before you turning WiFi back on.

The demo doesn't have any online so there's no reason to worry about that.
No one has been banned for playing a game offline with the 3DS connected to the internet to my knowledge, I myself did that when S/M leaked and have not yet been banned. Which is a bit surprising considering I have my favorite title set to a homebrew, I run all my cia homebrew while connected, have not turned off data sending (not that that really helps much), I basically do all the things you're not supposed to. Figure I've been doing it for so long that if I was going to be banned stopping now probably wouldn't prevent that.

If anything, they are more likely to ban him for running an out of region game, since the demo technically is released, and it's not region free like Pokemon was.

It's up to user's discretion with what they want to do with the demo. I'm just letting people know the USA region eShop doesn't have it at this moment. We already know you can get banned playing titles before official release. Does this applies for demos with no online connectivity? Perhaps not. I dunno and can't tell you for sure.

If I'm wrong, the worst that can happen for those eager to try out the game is that they end up waiting a little longer (maybe a week or two more?). Maybe they'll be mad at me for holding back on something they could have tried now. In any case, no harm is done except for some lost time and opportunity.

You are one sample of someone who hasn't been banned despite not following generally recommended best practices. Do you stand by your words that your advice universally applies for everyone? If you're wrong in that someone/people get banned for playing that demo too early, are you ready to face them and their blames pointed at you? For me, I cannot if that happened to them.

You and I both are trying to look out for this community, and everyone has their take and philosophical differences. I may not agree with all of your advice and you may not with mine, but that's okay as not everything works the same for everyone.

For anyone out there, do what you think is best for you. If you plan to check out that demo, make sure you play it safe.

:)
