Hacking Not sure if Updating my 3DS. NOOB question.

I have a 11.1 3DS with all the pirate's pack, you know, luma and a9 and stuff.
So, today I found an old friend and we want to be friends on the 3DS.
But as you know, Nintendo is blocking me to add friends until I update my 3DS.

BUT I really don't want Nintendo to come after me If I update my system.
Specially since they've already found that freeShop is running by their own servers (I hadn't read the full article about that)

So... I'm guessing that they already have a blacklist of all those who used freeShop, and they are just waiting for us to use that app and being banned... you know, like it hapenend with all those Pokemon Pirates.

So, I DO know that It was safe to update with Luma and A9... but... I'm not sure if it's safe nowadays...
Help?

freeshop downloads the games directly from Nintendo's servers using a title key. Nintendo cannot find the difference between eshop and freeshop download (they could, but it would be more complicated to them and could cause issues). It is safe to update sysnand to 11.2 if you have a9lh and luma3ds

ctr-httpwn can bypass the update requirement.

they got banned because they went online early and that is pretty easy to detect on their servers. Freeshop download and eshop download is harder to keep track of.

Playing a game WEEKS before its launch and online will obviously get you banned, despite it being played via a cartridge or a installed cia.

Homebrew and official stuff are two different things, do not mix them.

It's safe to update to latest FW if you're using A9LH (and it's not a9, that's the processor's name).
But it's not safe to update if you're on 2.1 on N3DS
And I'm using freeshop and no ban came to me

So, I updated my 3DS to the latest Firmware. And I added that friend.
I hope I won't regret this later.
