So if it is stored on the nand, then those systems that have bundled games cannot ever do a system format? Or does a system format never touch the ticket on the nand? Just trying to understand how this works.

i am pretty sure system format does not touch your tickets, at least if it does touch them, it does not touch all of them
you need tickets for everything, so you cannot have all your tickets deleted when you format because the 3ds would not even start properly because tickets would be missing
so what you would use 3dnus? and after installing them when you would go to the eshop it would just say to redownload?
3dsnus? no, it will not really help you with this, it is only for system titles (not games etc) -- and yes, you would be able to redownload them, although i guess the content would simply be installed to your sd card anyway, but maybe you can stop that and only have the ticket installed.
my first thought after reading that is a hacked eshop that would let you download any game, kinda like cydia on a ipod touch.
Cydia itself didn't do that, it was apps like Installous, Zeusmos, and AppCake that enabled iOS piracy.
