Since there are many people asking if they should update or not , why not put a stickied post about it?
(Or put it in one of the stickied threads)
I guess we do have to answer this thing daily... so I'll make one and leave it until the question isn't conatantly-asked anymore.

They have told us multiple times for months that they will NOT be releasing the kernel-mode hack.
Lol i can tell you must get so frustrated answering the same questions over and over :P
But you have to understand the info on the 3ds hack is mostly all speculation, so its hard for people to get a real grasp on what exactly is going on with the 3ds and its possible new "Ground Breaking" exploit everyone seems to be talking about.

*sigh* So guess that means i have no choice but to update then... :/
But why is it warning that a 5.0 update isn't recommended on 3DSbrew??

Oh well. Still would be nice to get some actual clarification from these guys giving people the OK to update and to disregard the updating warning, unless your a contributing 3ds hacker. That would be nice.

Mostly everyone is just waiting to be able to say "Alright Region-free 3DS! :yaynds:" Among many other stuff...

I fixed that sentence for you, because we all know this is the main reason people want a 3DS hack, and it is the only reason for most people....

Lmao very true! :P but at the same time, there are those that actually do care about whether or not the 3ds goes outta hand with piracy. And a region-locked 3ds is what most people just absolutely despises.

Region-free, that is what we expect!!! =D

I find it just plain stupid. All the other systems i knew, (my uncle's like to import jap. ps3/360 games) were region-free i believe. And i wonder when someone can make a region free flashcard for 3ds. Or maybe when neimod and yollow8's are far enough we'll just have a simple app. idk but we need something. jap 3ds is getting some really cool games coming out!

Despite what you appear to think, Nintendo and other companies do not exist to provide for gamers and satisfy their wishes. They exist to capitalize on the market created by gamers i.e. the games market. They are a business, not a charity, and their purpose is therefore to make money, not to serve gamers however the gamers would like.

Now, of course, treating your customers well can help with the making money, as satisfied customers are certainly more likely to return, and also to recommend the company to others. But when a relatively small fraction of the customer base would import anyway (regardless of how it may appear on gaming websites etc., the majority of the current gaming market demographic will not care much about imports), it's not as much of a problem to alienate that small group. Overall, the slightly increased loyal customer base they may achieve by allowing imports etc. is not worth as much as the increase in profits gained by not allowing imports (forcing local purchases at higher prices).

EDIT: Historically there have also been technical reasons for region lock, in that European TVs used PAL and US and Japanese TVs used NTSC, and they weren't compatible. Most modern TVs can handle both now I believe, but the "tradition" has stuck somewhat. It was never a technical issue for handheld consoles though.

I don´t mind buying the games but they(Nintendo) can´t say what I can buy!! (with region-free I will buy all 3DS games from japan, europe and usa! =D)

The reasoning behind the region-lock is to monitor sales, and if a game or series of game's sales do not meet the amount they wanted to sell, then they will just cut that region off altogether (ex: Digimon, .Hack, etc). Also, this is why there is the Activity Log and the warning that says certain data on your system is collected without warning.
