Yes indeed you can and you wont be banned for using XCI as long as you're playing it offline. I've done that since SXOS was out and at first it was okay but until I came across NSP, my opinion changed. There is so many source of NSP collection literally everywhere. UPDATE.nsp for games are easily accessible with a quick Google searchI can update all my xci games via nintendo online not wasting anytime here

If you create an Emunand with Sxos you can use that partition to play xci and nsp without connecting to internet . And when you want to play online do it with sysnand .So, in the end, even with XCI it is still guaranteed that we will be banned by trying to play online, correct?
I'm not too much of an online competitive freak, but I do enjoy trading pokémon online and a few casual battles.

Nintenod's security towards piracy is much greater than the 3DS. So basically when it comes to the Switch playing online with games you don't own is not an option if you value your account or Switch online privileges. Best advice I can give you is buy the games you love the most and learn how to use emmunand so that you can play your legit games online with your sysnand. Doesn't matter if its xci or nsp going online with them is a big no. Some ppl like to have everything in 1 package or taking up 0 space on the Sd card using an external HDD but if you don't mind installing many DLC and update on your nand or SD card then by all means go for it. Not really a hassle since you wont be doing often depending if the game stopped getting support in content. 90% of the time the errors are due to not having updated master keys you need to dump or download the latest keys.txt of the current firmware (8.1.0) for new game/dlc/update supportHo yeah i tried once , but had many errors and coudnt compile the game , i guess it has been updated .
