gba emulation vs 3ds piracy? pretty sure nintendo is not okay with either. so yeah to the owner it's the same thing.

You are right, Nintendo considers both the same form of piracy. From nintendo's legal page for those interested:

How Come Nintendo Does Not Take Steps Towards Legitimizing Nintendo Emulators?
Emulators developed to play illegally copied Nintendo software promote piracy. That's like asking why doesn't Nintendo legitimize piracy. It doesn't make any business sense. It's that simple and not open to debate.
People Making Nintendo Emulators and Nintendo ROMs are Helping Publishers by Making Old Games Available that are No Longer Being Sold by the Copyright Owner. This Does Not Hurt Anyone and Allows Gamers to Play Old Favorites. What's the Problem?
The problem is that it's illegal. Copyrights and trademarks of games are corporate assets. If these vintage titles are available far and wide, it undermines the value of this intellectual property and adversely affects the right owner. In addition, the assumption that the games involved are vintage or nostalgia games is incorrect. Nintendo is famous for bringing back to life its popular characters for its newer systems, for example, Mario and Donkey Kong have enjoyed their adventures on all Nintendo platforms, going from coin-op machines to our latest hardware platforms. As a copyright owner, and creator of such famous characters, only Nintendo has the right to benefit from such valuable assets.
Isn't it Okay to Download Nintendo ROMs for Games that are No Longer Distributed in the Stores or Commercially Exploited? Aren't They Considered "Public Domain"?
No, the current availability of a game in stores is irrelevant as to its copyright status. Copyrights do not enter the public domain just because they are no longer commercially exploited or widely available. Therefore, the copyrights of games are valid even if the games are not found on store shelves, and using, copying and/or distributing those games is a copyright infringement.

But you can see from the devs perspective, as well as Nintendo's, there are a lot of ways to play old gba games and such in the form of emulators for a lot of devices. They are not really breaking new grounds unless they enable playing 3ds roms for basically free. Since Nintendo doesn't take action against the numerous emulators out there already, I think we can safely assume they wouldn't waste their resources on hunting down distributors of old emulators that can be found anywhere.

Why would they open themselves to a bigger chance to get on the really bad side of a huge corporation when it's against their stance on the subject in the first place? What they are doing already is putting themselves somewhat in the crosshair, why are we even trying to demand something from someone who works for free?

So Aliak and 17320 can't do it? is that what your are saying? What if someone else joins and do it? hmmm?

That's what I thought.

I'll refer you to point #9 of the 3ds scene minutes.

"They're could have been a rom loader over a year ago but nobody did it, there could be one based on OSKA but you'd be relying on the same group of people that didn't do it before to do it now"

You all need to just accept that those with the abilities to allow warez have no interest in a public release. Just deal with it and accept what we have. You want roms? You have options.. God I'm so sick of this. I don't want to ignore 90% of the temp for stupid shit like this.

But this has copyleft isn't it? So anything done with OSKA can't be closed source or not shared publicy.

I guess you could make some private loader, but yeah you're right. You'd need something like the AGPL to get around private sharing of one, arguably.

OSKA forked bootstrap of KARL3DS when they don't have license. But current OSKA has GPLv3 license and current KARL has BSD license. The fact can confuse.
And OSKA bootstrap won't work yet.
I suggest to stop the development of OSKA bootstrap and use KARL bootstrap to avoid confusing.

Like or opinion.

EDIT: I stopped OSKA bootstrap development and started KARL bootstrap development.
