I wanted to make mods for Animal Crossing: New Horizons (Changing models/Textures) and Super Smash Bros. Ultimate (Same thing). will I get banned for that/having a cfw alone?

The general thing people do to avoid bans is use an Emunamd and block all Nintendo servers. Emunands are basically just a copy of the internal storage of the Switch that runs on your SD card. Having it run like this means you can keep your Sysnand clean. The Sysnand is what you keep stock and never use CFW on. Even this has ban risks though. Indeed, just as good as 9dns I think.The only way to not get banned 100% is having your console on airplane mode ...other else you are probably doomed.
There is always a chance of getting banned when going online with a hacked console.
