Nope. The protocol used is not what defines piracy. Although, the following example did use p2p software, the whole point of the article points to someone illegally downloading a song.thats why some people put passwords on the zip file of downloaded stuff and use mega since thats two layers for encryption and it can't be told if its pirated or not unless some one has the decyption key and the password both would take millions of years to crack and naming the file to some thing like my birthday party video would also make it hard to tell if its also encypted so the only way they can find out is to find the pirate site that has the password and download link on it and they would also have to make an account

they were probs using torrents with torrents your also uploading and did not turn seeding off torrents are fast but not safest way
And I agree that the easiest way to get caught is using p2p software/protocols like torrents, but again that's not what defines piracy.
