thats why some people put passwords on the zip file of downloaded stuff and use mega since thats two layers for encryption and it can't be told if its pirated or not unless some one has the decyption key and the password both would take millions of years to crack and naming the file to some thing like my birthday party video would also make it hard to tell if its also encypted so the only way they can find out is to find the pirate site that has the password and download link on it and they would also have to make an account

they were probs using torrents with torrents your also uploading and did not turn seeding off torrents are fast but not safest way
Nope. The protocol used is not what defines piracy. Although, the following example did use p2p software, the whole point of the article points to someone illegally downloading a song.
And I agree that the easiest way to get caught is using p2p software/protocols like torrents, but again that's not what defines piracy.

Note that the article starts with how a woman was fined for illegally downloading, not for using Kazaa

Yeah but you're arguing a case where a woman was quite literally "made an example of".
The media company was trying to use fear to keep people from pirating their content, instead of actually making people want to buy the content.

Piracy of music and all forms of media is so rampant that it'd be financial suicide to try to go after every single person that pirates something you make.
And it's also PR suicide.

Look at where the music industry is now. Everyone pirates music, basically all the time and the only way they can make money is by making music providing services actually good and actually worth spending money on.

Yeah, Piracy sure is horrible. Poor multibillion dollar music companies, they had to actually make good services so people would pay them.

Go figure. Things sure are soooo much worse now because people pirated music. I sure miss it when a CD that costs them 10 cents to produce costed me 30$.

You are absolutely right on all points made.
But the article is still valid for the sake of an example on what is and isn't piracy.

Doesn't change a thing. Those laws still exist to stop you from pirating

eh but its like all those shitty games in the app store that cost money that have no demos would you waste money or pirate a shitty game not worth your money. also buying both pokemon versions is not worth your money since most of the game is the same as the other version sun and moon might change that a bit but most of the game will play the same so its like buying the same game twice that just has different pokemon you can catch

I don't play shitty games at all.
I read reviews of them and judge whether it's worth my time and money yes or no.

thing is reviews are the guys playing its opion or not every one likes different types of games you have to play it for yourself to know if you like it or not and reviews don't show you the whole game only small parts of game play there might be a part of the game thats not showen thats very bad for you and the other person might think its good watching reviews also causes spoilers

I'm still on 4.5.0-5

why?
- I didn't need to update (gateway worked fine), so yeah, partly laziness, partly "don't fix if not broken".
- I didn't use my 3DS for more than a year
- My version doesn't have the correct Internet version (-5 doesn't work with Ninjhax, it requires -7)
- I'm afraid of updating/installing CFW but messing it.
- I'm afraid of losing gateway usage if I go with CFW. (I like using 3DS format instead of cia)
- I would need to convert games to cia (unless now they are all in cia format?)
- I still don't need it for the moment, so I push it back for later.
- It will require time to read and understand what I'm doing and why (I don't like doing things blindly in hacking), understand how the scene progressed since 7.x
Everything he said is the same exact reason I haven't done any modifications to mine in years. If it ain't broke, don't fix.

We're steering quite a bit off-course here on what the thread originally was about, so this will be my last post on this matter.
I've been playing games for the last 20+ years. By now I know what genre I like or not. I use reviews to sway my opinion on borderline cases.
Also, I don't use a single review to judge a game. Take the Steam platform for example. In that case it's less about the reviews themselves, but how other players rate the game.

yes but thats other players opions they may hate it but you may not and any troll can just rate it low stars

Yeah but it's still a misnomer to use a circumstantial piracy case of a company going after some random woman to make an example out of her as evidence that "people get caught, it happens." For every 1 case of a company going after someone for piracy there's another ten million where people got away with it.

Of course piracy is illegal, nobody in their right mind would argue it isn't.

The argument for digital media piracy is that there's virtually no negatives to it in the long run. You're more likely to win the damn lotto then you are to get caught for it, and nobody stands to lose anything from it except that maybe the companies that create sometimes have to make their services better to get people to stop pirating. And it can even be argued that media companies often gain where they wouldn't have otherwise due to things like word of mouth, pirates spreading a product to people that go forward and buy the product legitimately.

And in an industry where media companies treat their consumers like numbers instead of people, I'm not shedding any tears for any damage it actually does do to them.

well think of piracy like this it isn't legal but can be useful you don't have enough money to buy a game so you play the pirated game untill you do and when you have the legit copy you tranfer your save file the company does not lose any money once you buy it and you still got to play it before you bought it it does not cause any damage if your going to buy a game you pirated anyway or stop playing the pirated game and delete it right away because its shit it gets bad when some one straight up is lazy and pirates and never buys the game ever and plays it all the time

does that mean they should make ad blocking illegal it kinda does the same thing used games also do it as well

In most countries ripping off content from physical copies you own ( CDs, DVDs, carts, etc ) is illegal, let alone downloading pirated versions of them. Whether that is a shitty law or not is irrelevant. Piracy is illegal. It's not debatable.

thing is is using adblock illegal no and it prevents sites from getting money from ads is giving a game i don't want to my firend illegal no and he can still play it with out paying are used games illegal no and buying a used game only gives the seller money not the company who made it so the company does not make money of that sale their are many things that have the same effect as piracy but are legal but making piracy legal would encourage more people to do it and make it even worse then it is now however with used games you still have to pay but the dev does not get any money so it can't be done heaps and heaps unless you have alot of money and with firends they will have to want to give you the game or share it with you but adblocking kinda causes the same amount of money loss if piracy if not more any site you go on with adds on it with it turned on they lose money

Take the reviews of No Man's Sky on Steam as example. Are you telling me that there are 72.000+ players that are giving it a bad score just to troll?

I used that article, because I was under the impression that hacksn5s4 thought it was okay to pirate as long as you're not caught. Which ofcourse isn't true.
So far I've only been playing devil's advocate in this thread, so none of what I said so far is necessarily my own stance on piracy.
Here is my stance on music piracy:
It's not a good thing to pirate, however you barely hurt the ones that really matter.
Take the following link for example. It shows that the ones actually making the songs barely get any money for their work.
https://torrentfreak.com/music-sales-are-just-6-of-average-musicians-income-130114/
Record labels are known to be crooks, and I feel no remorse for any damages they sustain.

ps. If this post seems a bit garbled and going all over the place, it's because I'm tired and still kinda sleepy

remember kids its only illegal if you get caught well its not but it has the legal effect unless you get caught probs no ones life is 100% legal and they have done some thing illegal and either have not gotten caught or it was not a serious thing and they only got a small fine for it real world crimes are the worst ones not cyber losing sales isn't going to kill you nor will you lose any thing in your house also making games movies and music etc isn't all about money its mainly about how good the game and movie is and if people will enjoy it

The thing about ad blocking is that it was a response to the intrusive and abusive ads that began to plague the internet. Ad Block Plus has actually put together a set of rules for advertisers to follow that would get them on a non-intrusive ad whitelist allowing their ads to get through on default settings.

https://adblockplus.org/en/acceptable-ads#criteria

Well, maybe the record labels should give them a better cut of the actual profits or else musicians won't sign with them anymore. Maybe the record labels need to find a way to make more money so the musicians are making enough money with your current set up.

If record labels can't money off your music and take most of what little you do make, what the hell are you letting them take your money for? Make money from your music yourself or find someone who actually can make you money off your music for you and give you a cut. That's what a record label is.

If you still can't make money, maybe the music isn't worth anything. ¯\_(ツ)_/¯

This is basic market stuff, I'm surprised I have to explain this.

Also No Man's Sky is a perfect example of the exact point you were trying to refute, the irony there is pretty outstanding.
It's not a bad game by any means. It's a decent game made by a developer that either lied to people or bit off more than they could chew.
Now the game is being negative review brigaded by people that don't like Hello Games or people that felt mislead by the game's advertising.

The product itself isn't representative of the score it has been given by the masses, which is the one thing the score is supposed to do.

Here's another example of brigading a review system to falsely represent a product.

you can disable that to block all ads

you can disable that to block all ads
That's why I specified default settings. The point of it being on default settings is that it means most Ad Block users will have it enabled thus incentivising advertisers to follow the criteria put forth.

Lol, I said I didn't want to go into a rich/poor argument to avoid such a response. Guess it didn't help. Also, I didn't say anything about my situation, nor was I talking about myself but more in general.

And who are you to tell others what is justified or not? That is your point of view and you can't force that on others.
I can imagine a few examples where someone would rather pirate than buy the actual game.
  • E.g. a poor family having just enough to buy a 3DS for their son, but not enough to buy the games.
  • Or what about games that are only released in one region and not others?
  • Let's not forget that you and I live in a first world country, but not everyone has that privilege.
I'm open for a discussion like this, as long as you don't attack me personally.

Being poor doesn't justify piracy
Games being released out of your region doesn't justify piracy
Living in a third world doesn't justify piracy.

No matter how you turn it, the fact remains that downloading 3DS games without paying for it is piracy.
Excluding free games in the eshop obviously.

Piracy is wrong.
Everyone does it and neither do I care about it.
But you just cannot justify it.

If you where to be caught, you can't use an excuse like "I'm poor" or "the game hasn't been released in me region"
Judge would say "get a job" or "import that game".
