I just downloaded Steel Diver: Sub Wars today and to my surprise it is in Japanese! 
I've been playing a Japanese MH4 rom recently. I'm not sure if that has anything to do with it. The icon on the menu and the suspend menu have its name in English. It's only the game itself that is Japanese. To clarify I downloaded it from the NA e-shop.
Also it gets stuck on the closing software pop up when you try to exit it.
I downloaded Retro City Rampage DX at the same time. It is in English as expected.
