Actually even if you do have a out of region game on your 3ds the e-shop will detect the game no matter what. The only problem with that is the e-shop will not implement updates, and it will not fix the out of region games.

also 3D visual experience thing just gives you ERROR_FILE_LOAD or something like that
How did you get it to work?
The video player looks for different video files based on the region of your 3DS, which tend not to exist, so the file isn't found. You can use the region emulation feature of Luma3DS to spoof the region and watch videos, like so:
  • Create a file called 000400000009af00.txt with the below text in it.
  • JPN EN
  • Place this file in microSD:/luma/locales and will force 3D体験映像 to run as if on a Japanese system, meaning the video will work

It's not the Japanese video btw, it might be us though
