Gaming Question about CFW games

I am new into 3DS gaming and wonder about playing games online on CFW. Some of you have the opinion that its save to play games online without private headers and some say you might get banned. Whats right now? Do i need private headers for games? How is it about CIA games playing online and what do i need to keep in mind to play games online on CFW?

.CIA don't have private headers or need them that was only for flashcarts Gateway3DS/Sky3DS ect. So yes it's totally safe to play .CIA online

Can you explain to me why .CIA is safe to play online? Because I heard about Nintendo can see if your 3DS is Jailbroken and even if games are bought by yourself or not. I just dont want to get Flagged and banned in the future
