Hacking Possible first 3DS homebrew or fake?

It's false until it's proven true or from a trustworthy source.

For example if some no-name site posted that Microsoft was adding ARM support to the next version of windows, people would scoff... but when Microsoft posts about it, people accept it as true.

If this was real it would be much larger news than it already is, we've seen this countless times before with people who have claimed to have hacked the DSi (i know it's hacked now) and other devices. Also if it was me who managed this i wouldn't release such a dodgy pic.
