I heard Gateway/Sky3DS users haven't been banned. Is this true?

It's "easier" for Nintend0 to know if SuMo is a pirate copy if it's digital and connects to the internets, I quote because a lot of reviewers got physical copies, but there's still same risk as always when using headers from other games.

I changed my localseedinfo_B file from other cfw 3ds available to regain online access however cant log into nnid as console is still banned
