Homebrew Question Pirated Games Account and Update Games Offline

Hey Guys first sorry if my english isnt the best hope yall understand my problem anyways.
So my Switch got banned because i downloaded and played illegal games from a free shop.
Now my question is if i buy a new console and log into my nintedno account where i used played these games will they ban me again ?
And the second question is: does someone know how to download a Game update which is required to start a BOUGHT game on a banned switch i do have CFW so this isnt a problem.
