Hacking Pre owned switch lite risk of ban

Hi everybody, I bought a pre owned switch and the owner told me that he didn't set exosphere nor incognito, just airplane mode on emuNAND and then connected the switch to the internet, for what I assume downloading some games on tinfoil, my question is if this switch is bound to be banned?

I'd say, one way or the other never assume. It boils down to nin+end0, some they miss on the 'X' round of ban and the vicious cycle continues.

When it's pre-owned and cfw is on it, there is always a risk of getting banned.
If the seller did connect to the internet while using emunand, you don't know what kind of traffic went to nintendo's server.
But surely some data did transfer. They check for new firmware updates, news and other stuff regularly.
A ban flag with your system identifier could have already been transfered.
