Nintendo to start banning?

To those of you nitpicking the wording: It doesn't fucking matter. You run the risk of getting your Wii owned off the face of the planet by having either modchips or pirated virtual console titles installed/downloaded/hacked/whatever_word_suits_you. And even if you could somehow convince me (you cannot!) that the wording did point to simply one thing or the other, Nintendo simply has to update their EULA at any given time (again) and start pressing that big ol "you just got fucked" button and there isn't a damn thing you can do about that.

If it makes you feel better about your pirated VC titles to nitpick and say "oh lol I'm safe", thats fine. Whatever helps you sleep at night.

No seriously how would modchips "lead to serious injury to yourself or others" ?

Assuming you really are being serious (hmm), it's a bit of a stretch but surely they mean you may injure yourself trying to install a modchip [as a laughable effort to dissuade some of our more paranoid would-be modchippers].

Well I was serious, So I guess the only possible injury is electrocution.
But, who's stupid enough to keep their Wii plugged in.

I strongly second that, specially the It doesn't fucking matter part

They are talking about Modchips ...

I don't think this is legal as my wii was bought in 2006 and the EULA wasn't like that back then.

And I didn't accept this new one. I'm going to sue them.

Doesn't the EULA say it can be changed at anytime and without notice? I'm pretty sure I remember reading that on my Wii somewhere.
I'm pretty sure that it would be illegal for Nintendo in Germany to change the EULA ex-post. Then again, I'd be surprised if Nintendo didn't have some anti-piracy/-modding clause in its original conditions. Then again, who cares?
Didn't each and everyone of the last approx. 54709253 system updates say that "unauthorized modifications" might stop working once the update is applied? My Wiikey's still doing just fine.

Chapter: Unauthorized Devices or Accessories.

Your Wii Console and the Wii Network Service are not designed for use with any unauthorized device or any non-licensed accessory. You may not use any such device in connection with your Wii Console or Wii Network Service. Such use may be illegal, voids any warranty and is a breach by you of this agreement. Nintendo may take steps to disable any unauthorized device installed in your Wii Console, including, but not limited to detecting and disabling your Wii Console through the Wii Network Service and/or game software. If a modification is detected, your access to the Wii Network Service may be disabled and/or games may be unplayable until the modification is removed. Further, such use may lead to injury to yourself or others and may cause performance issues and/or damage to your Wii Console and the Wii Network Service. Nintendo (as well as any Nintendo licensee or distributor) is not responsible for any damage or loss caused by the use of such device or non-licensed accessory.

Are they talking about the VC games? Anyway to find out when this page was last updated?

"any unauthorized device or any non-licensed accessory"
Sounds more like a modchip they don't talk about software

Modchip? Software? Who cares. If they find you've been pirating VC games (which is much easier to do than detecting a modchip) they're well within their rights to ban you.

Don't believe me? Why not read the rest of the EULA instead of just focusing on that bit.

We may terminate this agreement, or any portion thereof, at any time, for any reason whatsoever. Such termination will void any licenses granted in accordance with this agreement and may prevent your use of the Wii Network Service. You may terminate this agreement by removing Content and Products from the Wii Console and forfeiting any rights to Points in your Wii Shop Channel Account. Termination of this agreement will prevent your use of the Wii Network Service.

We have no obligation to return Points in your Wii Shop Channel Account or Content or Products at any time, including upon any termination.

Even if that doesn't cover whatever they want to do they still have the backup of

QUOTEArticle: Current Agreement and Updates.

Nintendo may change the terms and conditions of this agreement, including the Wii Code of Conduct and Wii Privacy Policy which are both made a part of this agreement, at any time. A current version of this agreement will always be available on the Internet at http://support.nintendo.com. If you do not have Internet access, please contact Nintendos Customer Service Department and we will mail you a current version of this agreement, free of charge. We will post notice on http://support.nintendo.com of any changes to the agreement at least 5 days before the changes become legally binding on you. If you do not agree to these changes, it is your responsibility to cancel your Wii Network Service in accordance with this agreement. If you do not have Internet access, you should also periodically contact Customer Service Department, and ask whether there have been any changes to the agreement since the last version you obtained.

Then even if they DID manage to ban you against any terms and conditions, what are you going to do? Take them to court?

I'm sure the court would love to hear how Nintendo prevented you using stolen software.

Still, keep believing what you want.

From some of the posts I've seen, I truly do believe that there is a large contingent of people that will find a way to injure themselves. I have seen the absolute most horrible soldering jobs ever.
