Sounds rather cocky and "haha u got pwnd, please post here so we can flame u to death" to me. Maybe thats just my view, but i still find it very inappropriate to post stuff like that no matter what the meaning in that sentence was.

That's true...they should force the store to stop selling nintendo products, sue them also for damages due to the store leaking the game, and the game being ripped and uploaded, in a way they should be held responsible too. If the game was never leaked, it would have never been uploaded (so early)

Except the store didn't do anything illegal. Unless they signed a contract that said they wouldn't sell it until a certain date.

You can't sue AMPAS for screener leaks either.

In this case the store did break the street date, IIRC. So not only was it a leak of a high profile game, it happened before the retail release.

When whatever store started selling the Nintendo product they signed a contract with Nintendo. You can find copy's of the contract if you look hard enough. Theres a few things they have to adhere to, release dates being one of them. That store is just as responsible as the guy who dumped it. The fact is though, if Nintendo pull's the product from this store they lose sales, so thats not going to happen. Nintendo found the guy that dumped one of the biggest games in Wii history, and made an example out of him. Trust me, it worked. Might not stop them all but, I guarantee the uploading pot just got greatly reduced.

Nintendo has ruined this guy's life for the rest of it. From here his wages can be garnished and the money basically taken from him for the rest of his life till it's paid. Not sure of the exact laws over there but, it could possibly be handed down to his kids if he don't get it paid off before death. On a personal note, Nintendo went way to far with this.

If it hadn't been dumped and uploaded (which regardless of when it is done(*), is illegal) there would have been no damages.


*(technically if the copyright has run out then you could, software piracy is technically a time crime).

I'd wager, they found him, in part, because he ripped, uploaded, re-ripped, uploaded again to more sources, and then re-ripped, and uploaded to other sources, and talked about it on about 30 forums, and posted his receipt even, just so people would stop saying he ripped it wrong. Fame got him pwned.

No one claimed they are legally responsible. But stores in the US get fined for putting games out ahead of retail, so i wouldn't be surprised if its the same in Australia.

on topic though this sucks, it kinda reminds me of the xbox 1 hacking days microsoft went after the little guy soldering chips on boxs in his garage not the manufactures etc. just to make an example out of him. It does come as a shock but the more i think about it the more it makes sense cause aside from worthless easily hacked SM update what has nintendo done against all the piracy, next to nothing lol it had to be a matter of time

All I can say is that he was very kind and generous as a person, in the way he treated us in the forums. I understand there is a price to pay, but that is simply rediculous. Nintendo should see about hiring him to protect their interests instead of doing something like this.

i think the worst part for him is the fact that mario bros will never mean the same it used to mean. we all know the mario theme by heart and have probably spent hundreds of hours with mario and luigi growing up. and we all get a nestalgia when we play older mario games. i bet kongsnutz never plays another mario game again and he probably gets sick when he hears the theme music.
