Does anyone else's top screen feel "loose" when extended to one of the two(?) "click"/"lock" points?

Mine does. Also feels a bit sloppy left to right and obviously vice versa...

[EDIT]
TRULY feels cheapish to me vs. my DS lite and other older Nintendo portables.. I'm sure part of it is the weight(new 3ds xl is VERY HEAVY comparatively speaking almost as heavy as my shield which is just more solid feeling...)
[/EDIT]

Sounds like you just got a bad unit.
but it is a 9.0 unit, so I'm hanging onto it as I suspect that any further shipments will not be less than 9.5

It works, but it FEELS flimsy/sloppy, and I have no point of reference...

I'd return it if you still can, though the flimsy top is definitely a problem with the N3DSXL line, moreso with the Blacks than the Reds.

As for worrying about 9.4, nearly all inventory currently out is 9.0. Just check that it's QW10xx instead of QW40xx. It seems like Nintendo's initial shipment consisted of their newer batches FIRST, which means they're shipping older batches now, making it a great opportunity to get another 9.0 of either color.

I've read that this is part of the design, to put less pressure on the hinge so that it won't self destruct.
Not sure how accurate that is, but it makes sense to me, considering Nintendo's history with hinges.

I have no issue with my hinge. My only current gripe is the damn Gloss. WHY IS IT THERE?! IT LOOKS RETARDED!

I have a Red one. Dunno what kind of difference that makes.

As far as I know there are two different hinges. One that clicks and one that doesn't. The one that clicks appears to be more loose than the one that doesn't, but both are loose, more or less. It's part of the design for the XL model. I think it has something to do with the size and weight of the display.

Mine clicks but it's definitely not loose. I have played with a regular 3DS XL and can attest to that. The build quality seems to have gotten better on the upgrade. I'm unfortunately not an owner of a regular 3DS XL but at least from my hands-on experience it feels better. Now, about that fingerprint magnet gloss...

did you tried the old 3ds xl? its same thing, people says its to protect the screen against cracks...

i also have a ds lite, and doesn't do that, but had 2 3ds xl, both have that loose lock

to explain better heres a random youtube link of the "nag"

notice its a OLD 3ds XL

I guess that overall I'm more concerned about the horizontal slop in the hinge given that the screen connector has to be one of those super flimsy thing ribbon connectors.

The vertical slop is just annoying if I shake my hands a bit as I've really only used my n3ds reclining flat out. Mostly because I'm waiting to see if gateway ever does anything and don't want the hassle of transfer retail cart save to something fc friendly...

Also, so far I've only used the 2nd down vertical positiion as the 1st is too vertical, and the last too "flat".

I'm also wondering as to how teribly difficult it was to get the back off to swap out the shipped uSD for a 64GB. For a while there I thought that they may have made a mistake and glued the shell halves together as Nintendo's own dox make it look like a simple pop open. Although TBH I was trying to adhere to their use teh stylus luke instructions rather than my fingernails which would seem to be easier(and so I hear tell now)...

So at the end of the day I'm still concerned with their hinge slop, although more specifically the horizontal...
