It still probably wouldn't be open if online installation has to happen. My 3DS didn't download 9.4 when I had my wifi on for ninjhax install and 3dscontroller.

do you have spotpass turned off? hopefully that's enough. I don't live anywhere near a Nintendo Zone so i should be fine hopefully

Sorry this might be off topic, but if GW's update requires internet access to setup/use, won't there be a risk of downloading 9.4 while our wifi switch is on?

Ehh, its more likely the payload will be on a QR code or stored on the SD card.
