Sheesh again with the lets go to a site that is full of how to's on running backups and call people bad......if that's your opinion you can have, but you came to the wrong place if you want to perform some battle cry, I get the impression some people just come here to argue the toss.....knowing they will have a constant stream of people to argue the toss with.....I say just ignore it :lol:
BTW I wasnt saying that people are bad, just that it is illegal, and some like to lie themself otherwise.
 
Nah bro see in most states it is not illegal to backup your own games and play the back ups. In most states the purchase of a flash cart is legal. There is nothing illegal in most u.s. territories about flash carts and playing YOUR OWN back ups. Nintendo tries to tell us its illegal and its not. However piracy is and even if you dont pirate using a flash cart on the 3ds breaks a contract that you enter into nintendo with. So while not legal since you broke the contract nintendo can sue you for damages and copyright infringment. However they have to prove with evidence you used it to pirate software.

Now im not going to argue with anyone about piracy. Unless nintendo can produce evidence that you pirated software you are pretty much in the clear in the usa. Apple tried and failed to make it so you couldnt jailbreak your device and failed. What makes you think ninty will be more successful? Apple makes more money then nintendo and has better lawyers and they couldnt do it.

The last thing i have to say is before you judge people for piracy(or ANYTHING for that matter), everybody lies. Youve lied to yourself or your friends or parents or someone you dont know. if you lie on purpose and had the intent to lie you are guilty of an immoral act. Under certain conditions lying is illegal. If you tell your friend some guy or girl is a whore and that person or someone else hears you, you are guilty of slander which is a crime. You directly influenced someones reputation by telling someone that, while it may be true you have still committed a crime.
 
Simply using a flashcart is illegal in the US since it circumvents copy protection in accordance with the DMCA. Its not legal in only some states or areas, its illegal everywhere thats why customs seizes carts from the mail and then sends them off to be destroyed.
 
It is not illegal to own or use a flash cart for what they were truly designed for. Look it up dude. It is illegal to use them for piracy. It is illegal to import them. It is legal to own one.

In the 90s nintendo lost a lawsuit because the device in question had a back up function like gateways. Importing them is illegal. Owning is a gray area. It doesnt circumvent copy protection to back up your cart cause YOU own it or play homebrew. If you distrubute your back up then it circumvents copy protection because you willfully copied something that is copy right protected. If you keep it for yourself and no one else as long as you own a physical copy of the game you are ok. Well as long as it doesnt circumvent drm. That is one thing im unclear on. How many of theses games actually have drm on them?

If it was completely illegal to own every single person who has ever bought one would be fined and/or imprisoned. Not to mention US based businesses who sell them would be shut down, fined and ordered to remove them from sale.

Notice there is something on there about modchips. I dont this flash carts are considered modchips since they arent permanent but what do i know.
