I bought this 3ds pre-owned
The 3ds does not give the message if I insert the sd card that it came with so if I remove the sd card I get the error stated in the title.
When I put in the micro sd into the computer it shoes luma is installed on the 3ds but when I go to open the homebrew menu it doesn't
work so my idea right now is to get a new micro sd and follow the luma installation on it and see if I can install luma on the ds with the error
it is giving me. Does anyone have any idea of the issue going on and can help me out I would gladly appreciate it.

If it shows the firm patch error, it means it already has Luma installed, so all you have to do is update Luma to the latest version since the error comes up if you are using an old Luma with 11.8 or higher firmware version.

Here you can get the latest Luma: https://github.com/AuroraWright/Luma3DS/releases
And just in case: https://3ds.hacks.guide/updating-b9s (if current Luma version is 7.1 or higher, you can see version by holding Select when the system is turning on) and https://3ds.hacks.guide/a9lh-to-b9s (if current Luma version is 7.0.5 or lower).

As for why the error only shows up without SD card, it's because SD card has updated Luma, but SysNAND has an outdated version, meaning the one you have to replace with the updated one is the one found in SysNAND.
