A. Nintendo doesn't give a Sh** about what you
do with your 3DS.
B. They can't tell if your using a EmuNAND, only if your using Cheats on an
online Game for Example. Or using Software from other Regions.
C. 9 + 10 = 21, Diagnostic Information is sent to Nintendo about your 3DS' Firmware, but
not that it's a EmuNAND. To them, it's the same (Since it really is the Exact same NAND and Firmware.)

What about for example on Badge Arcade, where it displays that you're using rx or Rei right on the bottom of the screen. Don't those strings possibly get sent to N? I would think it better/safer to not include those - like AuReiNand.

It is most Likely sent to Nintendo, but the log_files and other Diagnostics are read by Servers, not observed by real People. Making it harder to get away with this, without getting banned. I would recommend to NOT use the Badge Arcade or any other Nintendo Software or Game that use's there Nintendo Network Services (Ex: Super Smash Bros. Badge Arcade, IronFall, SwapNote (Discontinued), and You-Tube (It Relays through Nintendo's servers; That's how Google Patched it.), and a few Honorable mentions. !!Just stay Safe!!

cia files wont get you banned, as ive been using a smash bros cia online for weeks and i didnt get banned

your cia allows save game to close ? I have one but can not save

Question i made a romhacks of mk7 and convert it to cia but when i choose online it says "Haha you are banned" (not haha only "nintendo has blocked online services on this device") but when i use my cart of mk7 it works perfectly.

I'm not thinking so! I've been using a USA CIA of Smash on my EUR 3DS for IDK, a year now...? Nothing has happened yet!
