Hello everybody! I want to know if I can get banned if I turn on that feature from friend list on a 3DS which shows what game are you playing to your friends.. I m asking because I can t play some games like Mario Kart with a friend or more just because they cannot see me playing in their game. I know because before modding my console they were able to see my lobby and join it.

You should be fine I have had this feature enabled on my homebrewed 3DS for years and Nintendo has not taken action.

That option does NOT hide what you are playing from Nintendo, ONLY from your friends, so it literally changes absolutely nothing ban-wise, just turn it on and you are fine, don't worry about it. Bans only happen if you pirate leaked games (since there aren't any new games coming out this can't even happen anymore) or if you cheat extremely heavily online on something like Pokemon (but only on the latest gen currently, meaning that since Sword and Shield is out, USUM bans no longer happen since Pokemon Global Link cut support for those), long story short, bans won't happen anymore unless something major changes or Nintendo decides to screw everyone over by a last banwave to say goodbye to the 3DS, which is unlikely...
