no!!! as I said before I've been using the leaked versions and I'm not banned it's nothing to do with version 0 or 16 his friend just happened to go online before the 18th and either doesn't remember or someone went online without him noticingMy guess is that your friend didn't use the freeshop version but instead use the leak version. The leak version is .3ds conversion and it has version "0" whereas the freeshop version is "16 or 32". The moment he went online with that leak version, he was marked.
You can freely play sumo as long as you don't go online until the 23rd. The evidence is strong regarding only getting banned due to going online in game prior to the release date of your region.I live in UK, England

Although this talk about people being banned WITHOUT going online is scary
simple fact is everyone got too comfortable with piraring and thought they were invincible, Nintendo may have been able to detect this for a while but think about this logically, when is the best time to ban a bunch of kids games consoles?

I don't think so. The save data's date relies on your console's date. If you happen to forgot to set your console's date (i.e you're on jan. 1, 2011 now) and made a fresh save data, the save data will have a starting date of jan. 1, 2011.So... everyone will be banned who has a savestate which was before the release?

I played pokemon moon on it's first day of leak. I did play it a lot but I never went online. I did open wonder square or whatever, But I never specifically logged into the online services (I had nagging thing in my neck telling me to definitely not to)
I should been in first wave of bans if internet connectivity with playing the game was enough. I still am not (I out of nervouseness logged to eShop 10 minutes ago) and am not. It definitely needs something, and you specifically connecting to the online services within the game.
Also leaving the game on while putting console in sleep mode, in my charger, connected to my home wifi.

It would be troublesome for ninty to ban every console with save game dates during the period of the leak because they will not have a solid evidence that you indeed played with the leaked game or just coincidentally have your date set to that period. If an unfortunate, legit player were to be banned and to complain, they won't have a choice but to lift the ban for him/her. Once non-legit players sees this "loophole," and ninty, without a solid evidence, will have to lift everybody's ban.Yeah, but what about all the people that have game activity on the days preceeding the release date?
