You can't. Unless the owner tells you that it's displaying the banned error code, then you won't know until you attempt to go online with it.

AFAIK if you're banned the friend's list will throw the error too.

.cia files don't need headers.

It's about them using public headers. If you are banned for cheating, that's completely different.

As far as I know, using StreetPass don't get you banned.

I've sent a mail to Nintendo about my ban, pretending that I bought my 3DS this week with the error. I'm waiting an answer. In 2 days, I will be banned since one month (first ban).

I sent them an email asking for the 002-0102 error and the answer was "call to the customer service number".
