I'm betting Ninty is going on all the 3DS ISO sites and such, downloading any public headers, loading it on their database and log everyone who uses that header.

No need, they just grabbed the sky3ds template file, it's full of public headers they can use, why build their own database when one is readily available? I bet you every single card id from this template is on Nintendo's ban list.

Thanks Sky3DS. What would we do without you.

Oh, yeah. We would be playing games online, ban-free.

To be honest, if not for the template file, they would have done it another way (if not already) anyway, such as detecting simultaneous occurrences for a card id, it's not much complicated to set that up.

Can we add another question to the ban form? Ask if they had a NNID attached to their 3ds, if they have a Wii U attached to that NNID, and whether their Wii U can access online services if both of those are answered true.
I'm going to take an educated guess and say that the Wii U will be unaffected. Think about it, if you have a Wii U you are buying the games legitimately. As far as I know there is NO way to play Wii U games for free. I mean, you can have your vWii hacked to play Wii, GC, etc. but not Wii U games. So if they started banning Wii Us in addition to 3DSes, they'll lose out on quite a lot of potential profit.

I remember yesterday the OP was trying to call Nintendo again since it's been a while since he'd last called. Did he ever post the outcome?

Would be nice if people stopped asking how to be safe.

Anyone using pirated nintendo games online has potential to be banned.

Go buy your games if you care so much.
It's easy to be too care-free, but it's also easy to be too paranoid in regards to stuff like this. No reported bans of private headers yet, and the fact that I've been playing with private headers online ever since this started with no ban sent my way is all the evidence I need to keep on truckin' the way I have been.

wait , if i don't go to online in a game that have online , will i also be banned ?
what about non online games ? what the benefit to change the header to my header ?

No, if you don't go online with games obviously Nintendo isn't going to ban you from online services. You're essentially self-banning, though. And there's no point in changing headers for games without online features/game that you don't play online.

"You were caught using unauthorized devices such as flashcarts" that's all they'll say.

The only way of getting further information would be suing them so they have to show proof?

Pretty much. Or they'll use even more general terms like, "you violated your agreement with our ToS."

So what I'm gathering from the last few pages of this thread is that if I go out and buy a cheap online 3ds game and use that header I should be all right for the time being.. Would my vaguely researched assumption be correct?

I wonder if Nintendo can tell the difference between CIAs and 3ds/z just from looking at the activity log... Like what if you play offline games as CIA and online games as 3dz with private headers. If they start banning for CIAs I wonder if offline games are safe.

Or you could just take the minimal precaution of changing games you play online to private headers.
I know.

Except I don't own any games for 3DS, except my MH4U copy that will arrive on the 13th.
Seconds, There is little to no information yet on how bans are being ditched out. I am well known to ban waves, I survived 4 ban waves on PS3 and still going. If the ban can be detected even on private headers, I Don't want to get my MH4U header "dirty"
Third, just playing on CIA, by default, they have the same ban % as a private header
