did my question about if the people with bans were using a different region/region free game ever get answered? That could account for why it's only a small % of the population that uses pub headers

I did answer it but I didn't tag you in it as I couldn't remember where it was, there was 178 more messages by the time I got to reading it

Anyway yeah I did use out of region roms, quite reguarly. I didn't use them online though incase they ever needed an update.

Interesting, be nice to hear from the other people with bans if they all used out of region roms

I got through and they basically said It takes aslong as it takes, expected better CS from Nintendo tbh, Oh well, I'm off to play Majora's Mask 3D :)

i have a sky3ds... i also have a load of original carts i was about to get rid of... how can i get the headers from these before i sell them?

Is it legal for nintendo to do such a thing? even though we using illegal roms?

I may have missed it but, right now, there's two key points of validation left for these bans:

1) Does swapping the wifi module, and thus changing the mac address, change a banned hardware to an unbanned one?
2) Has it been 100% confirmed that a NNID that was on a console when it was banned is still valid on a different model of the same console after banning?

For the first, I'm fairly certain the user that ordered it has not received it yet.
For the second, I have no idea. I have a test unit coming in the mail shortly which I wouldn't mind plugging a NNID from a banned console into (except, you know, that means someone would have to give out personal info and I am not going to ask anyone to do that).

We can take ban reports from now until whenever, but unless someone chimes in and says they were banned using ONLY private headers for online play OR exclusively cias and nothing else ever, we'll still be with the current situation.

Also, for the sake of data clarity and ease of reading, all these "lol Sky3DS" or "lol Gateway" comments are not helping. It has been stated that both cards have been the cause of banning, and until proven otherwise, public headers were the cause of the bans. The bans are card-independent, so this is an all-out anti-piracy measure by Nintendo, and not meant to make any one group of card users suffer more than any other. It is counter-productive to speculate even if this was brought about by one card or another, as the cause of the implementation of the ban procedure is irrelevant. It is way more crucial to understand the cause, the method, and the extent of the bans themselves

I dont believe you can rip the headers from them without a gateway, there's a thread somewhere that will show you how to hex edit the public template for sky3ds users to make you safer though.

And yeah of course It's legal, It's their network. You accepted their T&C when you went online. They don't have to provide you with any kind of multiplayer, especially when they're roms.

You could dump them and get the headers. But if you then go and sell the carts, someone else could dump any of them, and then both of you would be using the same header.

This is perfectly legal for Nintendo, since it is stated in the Terms of Service you agreed to in order to use a 3DS.

does this mean we can still play games, just not online?
So far, all reports say so, but it's too soon to know for sure.

You can. Just power off completely, put Gateway's launcher.dat on your SD, insert the original cart you want to dump, and run the browser exploit. You'll get the Gateway menu allowing you to dump an original cart to your SD.

This only works at 9.2 or below firmware though right?

hex edit the template?!..sounds tricky :(
also, are the headers in the template that sky3ds release, are these public headers... so risky to use these now?

Oh, I do have something relatively consistent to report.

I have been playing ORAS on Sky3DS with public headers for the past week, WITHOUT connecting online however I have left the wifi switch on for o powers. My friends have confirmed they can see me on the friend's list and see the game I am playing. I have periodically closed that game out and then tried going online using my eShop purchased Pokemon X. Thus far, I have not seen any backlash for this behavior.

So they are either not keeping a log of infringing with public headers and only instituting bans when something trips up their system event trap for this, or they aren't banning all infringers at the same time. In the case of the latter, only time can tell. But I will keep doing that specific behavior until something happens.

surely they cant totally ban playing of any game cart/rom online and offline? how clould they stop the 3ds from playing any cart/rom? online is possible as may have been proven, but offline is surely not possible to stop. And if this is the case, then surely it wont slow down piracy much, as can still get the roms and play...so could nintendo be wasting their time/resources?

maybe its not intentional by nintendo, but something to do with the launch of the new 3ds...maybe had to change some code to get the new 3ds to work online or function correctlt, which unfortunatly has caused this problem for sky3ds/gateway users

so you have had the game running on a public header with wifi on but just haven't gone into the actual multiplayer section of it? if so... thats interesting.
