Okay. So does that mean a patch to TWL could theoretically allow a DS forwarder/loader to use the IR module?

On the subject of the IR, would be interesting to use it for the GBC VC injections of GSC and their mystery gift feature. But that's discussion for another thread.
Whatever we can get at this point in time requires it to be DSi hardware. Taking a quick Google, it seems like the built in infrared port is a 3DS feature, unfortunately. So that's a no go.
...GBC games with an infrared port?
I see no reason why not. VC emulators run in 3DS mode, so it would have access to it.

Playing a 3D platformer with a d-pad is not a pleasant experience.
Especially not the platformer which introduced the masses to the importance of an analog stick.
To be fair, it's not like the original had super snappy and responsive controls, either. Plays much nicer on the 3DS though with the circlepad, plus the n64's analogue stick was more like an 8 directional stick, with the way it was designed, so the only difference on the DS, was that you had to press an extra button to run, rather than walk.

I find that it only works worse with the 3DS Circle Pad.
I expect analog granularity that's just not there. I make a small adjustment to my heading and nothing happens, which throws me off.

Skelux made a patch to the sm64ds controls so it feels more natural to run arround with a circle pad rather than with a d-pad. You should check it out.

Not asking for 3DS features like Streetpass. And we are hacking the DSi firmware on the 3DS to read what's on the SD card. Now the DSi did have that same thing, but not an IR, which was as you said built into the cartridge. However, we don't have a physical cart for this, so what if a little creative hacking/emulating could in fact get access to the 3DS IR while in DSi-mode?
We still struggling for IR in CTR mode. So not a chance in the next three years.

I tested the latest nds-hb-menu from ahezard with a lot of homebrews and DS Demo games. All worked perfectly except nesDS (white screen on boot). Good job ahezard!! I'm very happy to see this development!
If you would, I'm sure they'd love a list of the demos/HB you tried along with your model of 3ds and FW? ty

What homebrews did work with you?
It could help to make a compatibility list.

why would you support the shitty games first it would be better to support the best 3ds games first then do the other ones later

More importantly, why do you continue to be ungrateful? If you really feel this way, you should take a swing at enabling ds mode on the 3ds yourself, you'll find out that it's not as easy as you think it is.
