Back then when it first came out I was able to use it like all the time but now it gives me a massive headache so like I feel like I should just upgrade or downgrade to the 2ds xl.. any thoughts?

Ehh, just turn the 3D off then.

I have the 3D on all the time, slider almost to it's max.
 
Usually yes when I'm using a N3DS, not like most of the games I play nowadays aren't VC emulators

in Mario 3D Land and OutRun you're really handicapping yourself if you're not playing them in 3D; for most other games it's just a novelty but it's really nice... of course, if you can't physically tolerate the effect, then the 3D mode is not for you and Nintendo openly admitted this since 2011 (probably even the virtual boy)
 
of course, I always have the 3d activated at all times to play games an watch 3d movies, the only negative implementations I've found about the feature are the frame drops in Pokemon and the background blurring in NSMB2

I use it for remakes like oot, mm, starfox, etc. Also for 3d classics and Sega remakes. It's like making a new experience out of those nostalgic games. Some of the newer games work really well with 3d too. People bitch about the Pokémon 3d, but I think it had a nice balance and used it when appropriate.

Those blur effects were a nice touch in my opinion.
 
I use on mostly of the time too, just not when so much action (sahs bros/ mario kart) or I'm outside and away/no time of something do charge it xD
 
Since i had my first 3DS (aka New 3DS XL) i said "WOW FUCKING 3DS WILL BE AMAZING"

2 days later... i never used it again in my life.
also, i just use my 3ds to play only Pokémon. No more.
that would explain your disappointment
