It's not his fault, it is the person that had sold the device online or gave it away is responsible because of a contract agreement with Nintendo to not put the device up for resale.
Not really, Nintendo can't get to him or do anything to him since that EDEV Switch was not his to begin with, he bought it off ebay and he never went online with it, so your threats are basically a bit childish to be on here.

Second you're both very wrong. The contents of that NAND contained software made using Nintendo's official SDK and any software developed using the SDK remains the property of Nintendo or the license holder who developed it ergo by dumping the contents and releasing it he is liable for prosecution under copyright law. Whether he signed an NDA or not he still released copyrighted code (or in this case a binary) into the public domain.

Remember this is Nintendo we're talking about, the guys who go after anybody who dares infringe on their property.

.... Why would they make user profiles upload their profile images? Couldn't they just pull images from the local switch, since every switch is (intended) to have all the same possible images?

I mean, that, by all rights, is increasing the amount of upload/download/bandwidth usage unnecessarily.
I think you could be in a different fw version with different available avatars

While this kind of hacking is a stupid ass thing to do, using Polygon as a source for Nintendo news is just sad. They hate Nintendo and never say anything good, even when they do something good.

Infringe? He didn't infringe, there's a difference between dumping and infringement, welcome to gbatemp, hackers domain. Infringement would be if they took a Nintendo property and did a Metroid 2 remake and such, that got a cease and whatever order because it was based off there property and they knew who to go after.

This on the other hand, they do not and you forgot another thing, dev menu is not Nintendo, dev menu is apart of the Tegra unit, which is Nvidia and that's not nintendo.

Also this happens all the time with dev units, get used to it, companies haven't been able to do anything about it.

Can Nintendo be liable for this? Are they legally held accountable for the game's rating if a child sees this or something? Or is it fine because it's internet use and there's nothing anybody can do about that.

No. They tell you on every game that taking a game online renders it unrated and subject to anything. Probably takes the blame away from them.

There's a difference between copyright infringement and trademark infringement, what you're effectively saying it people who dump ROMs onto the internet are not breaking any laws by doing so and if you genuinely believe that than I can't help you. Do you really believe Nintendo wouldn't pursue BBB if they could find out who they are?

Who said I was talking about Dev Menu? The EDEV device has much more on it than just the dev menu and it was encrypted using one of Nintendos console keys which again are Nintendo's property. The difference between this and what's happened before is the guy who got hold of the unit decided to take pictures and post them on the internet which basically gives Nintendo a paper trail to follow back to him.

If people are genuinely posting pornography into Mario Odyssey (and it's possible this entire story is fake anyway) then you'd better believe Nintendo are going to track his ass down.
