It's not his fault, it is the person that had sold the device online or gave it away is responsible because of a contract agreement with Nintendo to not put the device up for resale.
Not really, Nintendo can't get to him or do anything to him since that EDEV Switch was not his to begin with, he bought it off ebay and he never went online with it, so your threats are basically a bit childish to be on here.

Second you're both very wrong. The contents of that NAND contained software made using Nintendo's official SDK and any software developed using the SDK remains the property of Nintendo or the license holder who developed it ergo by dumping the contents and releasing it he is liable for prosecution under copyright law. Whether he signed an NDA or not he still released copyrighted code (or in this case a binary) into the public domain.
Remember this is Nintendo we're talking about, the guys who go after anybody who dares infringe on their property.
