Hacking Buying a non-'NEW' 3DS XL

I wanted to pick my brother up a 3DSXL from Target, but I want to make sure the FW is 9.2 or lower so I can downgrade it and install RX tools with my copy of CN. Is there any way to ensure that it has an older FW?
