Hacking And so it begins

Wow. This is just weird. I bet this guy hasn't been selling those FlashCarts for years like others. And he gets arrested.

Hopefully this wont reach us... It pretty much scares us all.

he's been selling htem for a couple of years, he had a pretty popular website. What goads me is the innacuracies in the article.

Since when is an R4 a game copying device?

it calls him a 'counterfitter'

They are not illegal, no one has been to court no precedent has been set. They smashed the door in on his parents home at about 3am and were very aggressive about the whole thing.

I think, if he gets a good technical lawyer on his side he could walk, there is no modified code in an r4, it doesn't have any flashme or nopass, the card itself doesn't circumvent any security.

The wording in the uk on the law of circumvention devices is

" has only limited commercially significant purpose or use other than to circumvent protection afforded by a technological measure that effectively protects a right of a copyright owner
under this title in a work or a portion thereof"

Now I think there is a very strong argument the R4 has many other commercial uses than violating IP, aas a media player, programming tool, allowing you to play homebrew, an emulator.

we will see where this shakes out.

Oh, my! I saw this guy selling knives the other day in his store! He's not only dealing with illegal merchandise, but also a potential murder! *gasp* [/sarcasm]

Again, as one of the comments in that page said, another case of a private interest using a public service for its own benefit. If a flashcart is something illegal, it's for its POTENTIAL uses. And if you illegalise a certain object for what it *may* be done with it, then knives, CD-Rs, DVD-Rs, cars... well, just about EVERYTHING should be illegalised.

You're buying a new lead pipe to repair the leak in your house? They see a pipe bomb. You filthy terrorist.

dammit no wonder there's no R4's left that guy had them ALL!!

LOL where one falls another steps into the shoes and carry's on they will just go BLACK MARKET and still be sold the industry for backup/duplicate/clone whatever you want to call them devices is WAY TOO BIG to be closed down!

Lol i was thinking the same, man i hope that this doesn't get too serious in other parts of the world, i mean Nintendo, or whoever makes these anti-piracy laws, are pretty stupid. They don't look at the main problem which is the fact that their products are way too expensive for some people, so the only way or thing that people resort to is piracy, and as a result many people, like that welsh dude, can see a profit in this.

What the... they confiscated his passport just for that?

They should send all the anti-piracy agencies to Somalia, where they can do what they should be doing.

Some guy in the UK was nabbed for selling flashcarts and modchips a year or so ago as well, it's not really the first arrest of its kind.

welcome to the UK....

guns are illegal because you might kill someone
so are flick knives
so are butterfly knives
so is pepper spray
as are shuriken
as are any kind of taser
sword canes too
even "samurai swords" are banned.

its also illegal to carry any kind of knife pretty much (except a small ( < 3") pen knife)

I am sure the are other absurd things too, I just can't think of them this time of the morning. The people of this country have become nothing but a bunch of sheeple.

wrong he was nabbed for installing modchips, modifying hardware to circumvent security, very different.

Modchips are and have been illegal for a long time, this is very different. As far as I can see this is UK governmen agencies being used as hired muscle for a large corporation.

Meh , just trading standards flexing their muscles in case we forgot about them. It'll blow over and nothing will change. If the guy gets anything , it'll be a slap on the wrist and don't do it again , any thing more and you can claim breach of human rights here

I couldnt believe this when i read it this morning. You dont actually see the cards in many high street game shops anyways, its mainly internet retailers that sell them.

On a different note, according to this -

Official statements by the Entertainment and Leisure Publishers Association claim that the hardware irreparably damages the DS handhelds.

Are they having a laugh or what?
