the possibility is there, they might force an "accidental" update that they intend to use to brick your console, but the update doesn't seem like it was made for that purpose
so what then?
they warned you, they don't look like they intentionally wanted to brick your console in the eyes of the law
in the end, you might still hold a bricked console in your hands
there are many-many-many way around the law, nothing is 100%

This way they would not know which cart to block, as you would all be using different rom headers and therefore have different activity logs.
Having the same details in all logs gives Nintendo data to analyse, basically the flash cart companies are advertising the details to Nintendo in the logs.

Is that possible on any Flashcart at this time? Like Acekard if you play a game through it will the 3DS read the game or still as the flashcart?

So, play on your flashcard. They will not do anything to you. They CAN'T.
